The Manipur High Court on Thursday further extended till September 13 the interim protection granted to Advocate Diksha Dwivedi, against whom an FIR was lodged after she took part in a fact-finding mission regarding the Manipur violence.
Dwivedi, who has been booked for Sedition, Conspiracy to wage war against India, etc., had earlier moved the Supreme Court which granted her interim protection from arrest and liberty to approach the High Court.
A bench comprising Justice Guneshwar Sharma passed this order after the State government filed its counter affidavit in the matter. The Court has also granted two weeks’ time to Respondent no. 3 to file its counter affidavit in the matter.
Further, Dwivedi has also been granted the liberty to file a rejoinder in the matter. The matter is next posted for hearing on September 13.
It may be noted that before the Supreme Court, Dwivedi's counsel had urged that it would be difficult to approach the Manipur High Court in view of the situation prevailing there.
However, following Solicitor General's submissions, the bench comprising CJI DY Chandrachud, Justice PS Narasimha, and Justice Manoj Misra granted her liberty to appear before the High Court virtually.
The Top Court was then informed that both Dwivedi and her instructing counsel were receiving online threats. "You have liberty to approach in case of any grievance," the SC ordered.
Following this, she had moved the High Court and on August 1, the HC issued the notice in the matter while extending interim protection till August 17.
Senior Advocate Anand Grover assisted by Advocate A. Priyokumar Sharma appeared for the petitioner.
