Dog Bites: Madhya Pradesh High Court Asks Gwalior Municipal Commissioner To Come Up With Tangible Solution To Curb Stray Dog Menace

While hearing a Public Interest Litigation claiming "menace" of stray dogs and dog biting incidents in Gwalior, the Madhya Pradesh High Court asked the State authorities specifically the city's Municipal Commissioner to come out with a tangible solution by the next date of hearing.
Issuing notice on the plea, a division bench of Justice Anand Pathak and Justice Hirdesh observed, “Respondents specifically Commissioner, Municipal Corporation, Gwalior is expected to come out with a tangible solution on or before next date of hearing.”
The PIL claims non-action on the part of the respondent No. 2/Commissioner, Municipal Corporation Gwalior as the cases of dog-biting are increasing in the city. The plea alleged that due to dog-biting, kids, women and senior citizens are mostly effected because they might be not able to save themselves from the sudden attack of street dogs. The plea claims that despite Section 355 (Disposal of mad and stray dogs and other animals) of Municipal Corporation Act, the city Corporation is not taking adequate steps and due to this negligence, the cases of dog-biting are increasing day by day.
As per the plea, a 7-year-old kid was attacked by the street dogs and sustained injuries and had to get over 100 stitches during the surgery. It claims that there incidents of senior citizens being attacked by street dogs where they were severely injured. Thereafter, Madhya Pradesh Human Right Commission took cognizance of the matter and issued the notice to the State but no action was taken place in this regard.
The Corporation also constituted a committee to look into the matter of dog-biting. However, they still have not come up with an action plan and they are only taking action regarding the animal birth control and sterilization, the plea claims.
The plea seeks a direction to Gwalior Municipal Corporation's Commissioner to take appropriation action in accordance with Section 355 of Municipal Corporation Act.
While hearing the matter on March 19, the Court noted that the issue of menace of stray dogs and their constant hostile interaction with public at large was being raised by the petitioners.
The Counsel for the petitioners submitted that they intended to raise a public cause and to show their bona fide they would plant 50 saplings each at Hillock Village Alapur, District Gwalior within the next 30 days.
The matter is listed for further hearing in May.
