While hearing a criminal appeal, the Madhya Pradesh High Court took serious note of an Advocate's "contemptuous remarks" towards the bench where the advocate commented on the alleged increase in "pendency of cases" and sought transfer of his matter to another bench.

Noting the remarks made by the Counsel, the Court referred the matter to the Chief Justice and adjourned it without fixing any date for further hearing.

Justice Anuradha Shukla in her order observed, “In the light of statement made by counsel for the appellant it is evident that he is making disgraceful and contemptuous remarks against this Court, therefore, it would be appropriate that certified copy of this order is placed before Hon'ble the Chief Justice for his kind perusal and needful.”

During the hearing on March 22, the Counsel for the appellant argued for a considerable time and made the following remarks:

“This drama is going on in the court for the last 4 hours, I am sitting and watching. The High Court judges go to other places and suggest appointment of new judges but look at the condition of the judges, what happened in Delhi should also be seen. Here the pendency is increasing and we are being harassed. I will go and tell Mohan Yadav (Chief Minister) this evening. This case has been heard 20 times, with great difficulty my number came today. I do not want to argue my case here, send my case to another bench…”

Thus, the Court adjourned the case and referred the matter to the Chief Justice for his perusal.
