Former MLA PC George has approached the Kerala High Court seeking anticipatory bail in connection with a FIR lodged against him for allegedly making hate speech against the Muslim community during a channel debate.

Justice P V Kunhikrishnan orally said that he is a public figure and everyone listens to him that he must be careful while using words.  “He shall not be arrested till next posting date”, stated the Court and posted the matter to 17th February.

Crime was registered against PC George Eratturpetta Police Station in Kottayam alleging commission of offences punishable under section 196(1)(a) (promoting enmity between different groups on grounds of religion etc), and 299 (deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs) of the BNS, Section 120 (o) (penalty for causing nuisance and violation of public order) Kerala Police Act.

The allegation is that PC George made remarks against the Muslim community, stating that they are terrorist and communalists. It was also alleged that PC George said that there is no Muslim living in India who is not a terrorist. It is also alleged that he made comments to promote hatred against the Muslim community and stated that they must migrate to Pakistan.

The bail plea stated that the Sessions Court, Kottayam dismissed the anticipatory bail application of PC George on February 06.

In his bail plea, PC George submitted that the co-panellist who was aware of his temperament provoked him, which resulted in a slip of his tongue and that he made some comments in the heat of the moment. It was stated that on realizing his mistake, he apologised through his social media account.

PC George further stated that a crime has been registered against him, despite seeking apology as an attempt to destroy his reputation.
