The Kerala High Court has ordered preservation of the CCTV footage in the Cheranelloor Police Station after a 22-year-old mentally challenged person filed a petition before the Court stating that a fake NDPS case was registered against him out of personal rivalry.

The petitioner stated that he was bought to the police station by his father after his father received a call from the police station. There, an allegedly fake case was registered against him under Section 20(b)(ii)(A) (offence involving small quantity of cannabis) of the NDPS Act.

He submitted that it is incorrectly stated in the First Information Statement that the Sub Inspector brought him to the station and this can be verified after checking the CCTV footage of the police station.

The matter came before the bench of Justice V. G. Arun. The Court has posted the case to 23rd May.

The petitioner represented through his father submitted before the Court that the case was filed against him due to the political rivalry between his father and the cousins of the Assistant Sub Inspector (ASI) of the Cheranalloor Police Station.

As per the petition, 2 cousins of the ASI, Shameer and Illiyas belonging to the opposite political party had enmity towards the father of the petitioner for being part of a protest against Shameer's wife.

The protest alleged that Shameer's wife who was a staff of Kalamassery Medical College had illegally changed the birth certificate of a new born child.

The petitioner alleges that Shameer and Illiyas out of the anger towards the petitioner's father had trespassed into the house of petitioner's father's sister and attacked his father's brother-in-law.

Pursuant to this, a case was filed against them. Petitioner states that the ASI had approached his father multiple times to settle the case but he didn't comply. He alleged that he is now implicated in the NDPS case to get revenge from his father.

The petition is moved by Advocates Meenakshy Parvathy, Nandagopan M. C., Arun T. S., Sreeparvathi G. V.
