Kerala High Court Declines Pre-Arrest Bail To Actor-Comedian KR Jayachandran In POCSO Case

The Kerala High Court on Tuesday (January 14) dismissed the pre arrest bail application filed by Malayalam actor and comedian K R Jayachandran for allegedly committing penetrative sexual assault on a four year old minor.
He is alleged to have committed offences punishable under Sections 376(2)(n) and 376AB of IPC and under Sections 5(l), 5(m), 5(n) and 5(p) read with Section 6 of POCSO Act. It is alleged that the actor applied his fingers and tongue upon the genitals of the minor and committed penetrative sexual assault.
Justice G. Girish observed that prime facie case is made out against the actor and pre-arrest bail application cannot be entertained.
“the materials gathered by the prosecution in the instant case, prima facie point to the involvement of the petitioner in the crime, and also since the custodial interrogation of the petitioner is indispensable for an effective and fruitful investigation, the prayer in this petition for pre-arrest bail cannot be entertained,” Court said.
The actor had approached the High Court stating that he was falsely implicated in the case.
The Court observed that medical examination report of the victim proves that sexual assault was committed. It stated that the first information statement given by the victim and the statement given before the Magistrate also shows that the victim has identified the actor as the sexual offender.
The Court did not accept the contentions of the actor that the four year old child was tutored to give false statements against him to seek revenge. “It is not possible to accept the argument of the learned counsel for the petitioner that the victim child has been tutored to tender false statements implicating the petitioner in a crime of this nature”, stated the Court.
As such, the Court dismissed the actor's application for pre-arrest bail.
