The Kerala High Court on Thursday directed the State government to consider the representations filed by the Kerala CBSE School Management Association challenging the proposed guidelines framed by the Director of General Education (DGE) for setting up Fee Regulatory Committee and fixing the fee in CBSE/ICSE affiliated schools and unaided schools in the State that follow Kerala State syllabus.

Justice P.V. Kunhikrishnan passed the Order and further directed the State to pass appropriate orders in the matter within three months, after affording an opportunity of hearing to the petitioners.

The Court, while considering the two writ petitions challenging the proposed guidelines by the DGE, was informed by the counsels for the petitioners that representations conveying the grievance of the petitioners had already been submitted before the State Government. They thereby prayed for the issuance of direction to the State to consider the same.

The Senior Government Pleader Nisha Bose at this juncture, informed the Court that the Government had not taken any decision to issue an executive order or legislation, after the DGE had forwarded the guideline for constitution of a Fee Regulatory Committee.

"If that be the case, I am of the considered opinion that, before proceeding further, the representations submitted by the petitioners also can be considered," the Court held while issuing the said direction to State.

The writ petitions were thus disposed of.
