    The Karnataka High Court on Friday disposed of as withdrawn the petition filed by Nikita Singhania her mother and brother seeking to quash the FIR registered against them for allegedly abetting the suicide of Singhania's husband Atul Subhash, a Bangalore based techie.

    A single judge, Justice S R Krishna Kumar took on record the memo filed by the counsel for the petitioner and said “Counsel for petitioner has filed memo seeking for withdrawal of petition, qua the petition no 1 to 3. Petition is dismissed as withdrawn.”

    The court though passed an interim order of stay on the plea filed by the uncle of the main accused wife, Sushil Kumar Singhania. The court issued notice to the complainant Bikas Kumar and said “Counsel for Respondent no 2 (Brother of deceased), seeks time to file response, relist on February 26. Meanwhile there shall be an interim stay as prayed for qua petitioner no 4, till next date of hearing.”

    During the hearing the prosecution informed the high court that a chargesheet in the case is going to be filed. The counsel for the uncle argued that he is 70-years-old and the complainant is in furtherance of the death note where in my name is mentioned but the allegations made are omnibus against me.” He added “In the entire death note the deceased had levelled allegations against the wife and others.”

    The bench on going through the record orally observed that main allegations are made against the wife and others and not the petitioner (Uncle). Following which it passed the interim order.

    The 34-year-old techie also left behind a 'justice is due' placard and a 24-page suicide note. He made allegations of harassment against the Respondents, during an ongoing legal battle over divorce, alimony, and child custody in a family court in UP's Jaunpur district.

    An FIR was lodged against Nikita and her three family members by Bikas Kumar, the brother of Atul. The accused were granted bail by a court in Bengaluru on Saturday.
