Karnataka High Court Grants 90 Days Parole To Murder Convict To Oversee Agricultural Activities On His Father's Land

The Karnataka High Court has granted 90-day parole leave to a murder convict to oversee the agricultural activities of the land, which is standing in the name of his father.

Justice Hemant Chandangoudar allowed the petition filed by one Chandra who has been in judicial custody for over 11 years and undergoing sentence of life imprisonment for offences punishable under Section 302 read with Section 34 of IPC.

The petitioner contended that there is no male member to oversee the agricultural activities of the land, which is standing in the name of his father. He is required to oversee the agricultural activities of the land standing in the name of his father.

The court on going through the records said, “The petitioner was not released on parole on an earlier occasion. Given the facts and circumstances, the petitioner has established a prima facie case to release him on parole...The petition is allowed.”

Accordingly it directed the prison authorities to release the petitioner on parole for a period of ninety days from the date of release subject to the condition that the convict shall not involve himself in any unlawful activities during the period of parole. Further, he is directed to mark his attendance with the jurisdictional police on the first day of every week.
