The Jharkhand High Court has issued an order for a CBI investigation into a case where a female constable allegedly filed a false rape accusation against her male colleague.
The directive was issued on Wednesday following a petition filed by the accused, Anil Kumar, who sought a high-level inquiry and compensation for the 13 months he spent in jail.
Kumar, a serviceman, was acquitted of the charge under Section 376 of the Indian Penal Code after undergoing trial and subsequently petitioned the Jharkhand High Court for redress, citing wrongful imprisonment and an erroneous FIR.
During proceedings, Kumar's counsel argued that the allegations were fabricated by the woman (Respondent No. 9) at the behest of senior officials within the department, citing various documents and the respondent's testimony during the trial to support their claim.
However, the woman contested this assertion, contending that her testimony in court was coerced and that she had been pressured into providing false testimony due to intimidation by Kumar.
In light of the serious allegations and the involvement of law enforcement, the Court ordered, “Considering the nature of allegation and the fact that it is police department, this Court feels that some assistance is required from the CBI.”
“In view of the nature of allegation and the fact that police department is involved, Head of Branch-cum-DIG, CBI, Ranchi is directed to make an enquiry and submit a report to this Court in a sealed cover within six weeks from the date of receipt/production of a copy of this order,” the Court added.
The case is scheduled for further hearing on June 10, 2024.
