Gujarat High Court Upholds Fairness Of 'Random Algorithm' Method In Tender Selection Process

In a recent judgment, the Gujarat High Court has reaffirmed the fairness and transparency of a selection process involving the use of a random algorithm for awarding a tender to outsource manpower services.
The division bench, comprising Chief Justice Sunita Agarwal and Justice Aniruddha P. Mayee, the use of a random algorithm in the selection process for outsourcing manpower services is the most transparent and fair approach. The Court's decision came in response to a challenge to the selection process for outsourcing manpower services.

The Gujarat High Court today disposed of a Public Interest Litigation (PIL) plea for the strict implementation of the Gujarat Government's circular to use the Gujarati language as a medium of communication in all government offices, complexes, public spaces and privately owned offices and buildings meant for the public use.
When the Counsel for the PIL petitioner/organisation Gujarati Vichar Manch submitted that in most places the language is being used but private persons are not following the circular for private-public premises (cinema halls, restaurants, etc.), the Bench of Chief Justice Sunita Agarwal and Justice Aniruddha P. Mayee remarked thus: "Private people have to be sensitized, they can't be forced by a court's order. You start this with public meetings, and public slogans, there are many modes of sensitizing people. You can sensitize them about the benefits of using matrubhasha. We can't issue any mandamus to them."

Gujarat's Ex-Advocate General Suresh Shelat Passes Away At 85
Renowned legal luminary Suresh Shelat, a former Advocate General of Gujarat and distinguished senior counsel at the Gujarat High Court, breathed his last on Sunday after a brief illness. He was 85 years old and had commenced his legal practice in the year 1967.
Shelat was the Advocate General of Gujarat from 2000 to 2006, voluntarily resigning from the post in January 2006. With a remarkable career spanning 56 years in the Gujarat High Court, he was designated as a senior advocate in September 1995, concurrently being appointed as an additional advocate general during the same year.
The Gujarat High Court has directed the state government to promptly address the long-pending vacancies in the Gujarat Real Estate Regulatory Authority (RERA) and the Gujarat Real Estate Appellate Tribunal (Appellate Tribunal).
A division bench led by Chief Justice Sunita Agarwal and Justice Aniruddha Mayee expressed their dissatisfaction on Monday over the government's inaction despite clear court orders from 2021 and a commitment made by the State.
The Gujarat High Court today directed the Principal Sessions City Civil Court Ahmedabad to transfer the revision plea filed by Delhi CM Arvind Kejriwal and AAP Rajyasabha MP Sanjay Singh to a different court and further ordered the Court to decide the matter within 10 days.
The reason for such a transfer its that the presiding officer which had been dealing with the revision plea is currently on leave.
Hearing a Public Interest Litigation (PIL) plea filed by a Muslim Organisation against the alleged illegal conversion of 600-year-old Pir Imam Shah Bawa Dargah on the outskirts of Ahmedabad to Hindu religious places, the Gujarat High Court on Tuesday rebuked the petitioner's advocate by asking him not to 'bring Hindu-Muslim in the Court'.
During the course of the hearing, when the Court was informed by the petitioner's counsel that he was representing a trust that espouses the cause of the Muslim community, Chief Justice Sunita Agarwal remarked thus: "You are not espousing the cause of a community. Don’t bring Muslim-Hindu here. You are raising a dispute with regard to the identification of a property. So, don’t bring any community here. Please don't do this."
