The Registry of the Gauhati High Court placed a report before the High Court which shows that out of the 20 criminal cases against MPs/MLAs pending before the Principal Seat, 05 cases have been disposed of.
The division bench comprising Justice Suman Shyam and Justice Arun Dev Choudhury was informed that insofar as the remaining 15 cases are concerned, those are fixed in the month of February, 2025 for final hearing and disposal.
Insofar as the district judiciary of Assam is concerned, the said report indicates that 73 proceedings are pending before the various courts which are in different stages of their proceedings.
“Since this is a monitoring Bench, we refrain from passing any order in this regard, save and except, observing that the concerned courts may take all reasonable steps so as to expedite the hearing and disposal of those cases, if necessary, by fixing short dates and by avoiding adjournments wherever possible,” the Court said.
The Court was hearing a suo moto writ petition taken up in terms of the direction issued by the Supreme Court in WP(C) No.699/2016 on September 16, 2020 directing constitution of a Special Bench.
The Apex Court, in the said writ petition, had sought detailed reports from all the High Courts as regards pendency of criminal trials against persons involving sitting legislators/ex-legislators and to take necessary steps for streamlining the trials going on for expeditious disposal.
The Court directed the registry to submit an updated status report as regards the cases pending against MPs/MLAs before the district courts in Assam, before the next date.
Insofar as the States of Nagaland and Mizoram are concerned, the report of the Registry indicates that there is no case pending against any MLAs/ MPs.
The Court directed the Registry to furnish a copy of the said report dated January 24, 2025 to the respective counsel representing the States of Assam, Nagaland, Mizoram and Arunachal Pradesh.
“Insofar as the cases pending in the Principal Seat of the Gauhati High Court is concerned, Registry to also furnish an updated status report on or before the next date fixed,” the Court said.
The matter is listed again on March 11.
