Prima Facie No Error In Single Judge Ruling To Revise CLAT UG 2025 Marks: Delhi High Court

The Delhi High Court on Tuesday said that prima facie, there was no error in a single judge order directing revision in the results of Common Law Admission Test (CLAT) UG 2025 examination after errors were found in the marking of two questions.
A division bench comprising of Acting Chief Justice Vibhu Bakhru and Justice Tushar Rao Gedela was hearing an appeal filed by Consortium of National Lw Universities (NLUs) challenging the single judge order passed on December 20.
“Prima facie, we find no error in the decision of the single judge in finding two of the answers to the questions demonstrably wrong,” the bench said.
The Court also observed that the single judge examined the two questions carefully and was right in coming to a finding that a different view was not a plausible one.
While listing the plea for hearing next on January 07, the Court clarified that the Consortium can go ahead with the results of the examination as per the decision of the single judge.
“We clarify that there is no stay order passed and the pendency of this petition will not be construed as placing a clouds on the results that may be declared by the respondent in terms of the single judge order as well as further process,” the Court said.
In the impugned order, the single judge ordered revision in the results of two questions- 14 and 100.
It was held that the law does not commend a total 'hands off' approach for Courts where the answer key is demonstrably wrong, underscoring that injustice caused to a candidate must be undone.
The petition before the single judge was moved by a candidate who appeared in the examination and specifically challenged answers to five questions.
The single judge found errors in two questions to be demonstrably clear and said that shutting a blind eye to the same would be injustice to the petitioner and that it may impact the result of other candidates.
The plea was opposed by Consortium of NLUs, stating that an expert committee was constituted by the Consortium which has duly considered all objections received from various candidates before finalising the answer key.
