The Delhi High Court on Wednesday sought response of the National Investigation Agency on the bail plea of two Kashmiris in connection with a UAPA case registered in 2021.
A division bench of Justice Siddharth Mridul and Justice Talwant Singh issued notice on the appeals moved by Haris Nisar Langoo and Zamin Adil against the trial court order denying them bail on March 03. Both Langoo and Adil were arrested by NIA on October 22, 2021.
The matter will now be heard on July 18.
The case pertains to an FIR registered in October 2021 under Sections 18, 18A, 18B, 20, 38 and 39 of the UAPA and Sections 120B, 121A, 122 and 123 of the Indian Penal Code.
The FIR was registered by NIA on the basis of an order of the Ministry of Home Affairs (CTCR Division) alleging that the cadres of various terrorist organizations namely Lashkar-e-Toiba (LeT), Jaish-e- Mohammed (JeM), Hizab-ul-Mujahideen (HM), Al Badr and their affiliates are active in J&K and other places.
It is the NIA’s case that Langoo knowingly entered into a conspiracy hatched by terrorists and other co-accused persons to commit multiple attacks in the Kashmir valley.
He has also been accused of actively working for the ideology of the terrorist organizations as per the directions of various terrorist outfits in order to create unrest in the Kashmir valley and other parts of the country.
Against Adil, the agency has alleged that incriminating material was recovered from him during the raids and searches. It was alleged that Adil himself disclosed that he was well connected with network of terrorist organisations and provided necessary support to them.
Co-accused, 25-year-old Kashmir based photojournalist Mohd Manan Dar, was granted bail in the case in January by the trial court.
The appellants are represented by Advocates Tara Narula, Tamanna Pankaj and Priya Vats.
