Unnao Rape: Delhi High Court Grants Interim Bail To Kuldeep Sengar For Undergoing Cataract Surgery At AIIMS

The Delhi High Court on Wednesday granted interim bail to expelled BJP leader Kuldeep Singh Sengar, convicted in the Unnao rape case, in order to undergo cataract surgery at All India Institute of Medical Sciences (AIIMS) in the national capital.
A division bench comprising of Justice Navin Chawla and Justice Harish Vaidyanathan Shankar ordered that Sengar be released on bail tomorrow (January 23, subject to him furnishing a personal bond of Rs. 50,000 with one surety of like amount.
The Bench directed that Sengar will get himself admitted to AIIMS on January 24, when the surgery is slated to take place, to undergo the medical treatment.
“If for any reason the surgery cannot be conducted on the said date, the appellant shall surrender back to jail by 7 PM on January 24,” the Court said.
It added that on being discharged from the hospital, Sengar shall surrender to the concerned jail superintendent latest by 12 noon on January 27.
The Court issued notice on Sengar's application seeking suspension of his sentence in the case for 30 days on medical grounds.
During the hearing, Sengar's counsel submitted that the expelled politician was advised by AIIMS for cataract surgery for which he has to be admitted on January 24. He drew Court's attention to the orders passed by a coordinate bench on September 05 and December 20 last year by which Sengar was granted interim suspension of sentence on medical grounds.
The counsel appearing for CBI submitted that Sengar's medical documents were verified from AIIMS and were found to be genuine.
Advocate Mehmood Pracha appearing for the victim submitted that in the order passed on December 20, 2024, it was clearly stipulated that no further extension of interim bail will be granted to Sengar. It was also contended that Sengar cannot, on his own, choose or determine when he will take the treatment at endlessly keep praying for extention of suspension of sentence.
It was also submitted that the victim and the family were facing grave threats from Sengar and therefore the extension must not be given.
The Court noted that presently, there were no allegations of Sengar violating the terms or conditions on which he was earlier granted suspension of sentence.
The Bench directed that on constable of the Delhi Police will remain in the private ward where Sengar will be admitted. It added that the police official will not permit more than 2 visitors to meet Sengar at one time.
“A competent officer of CBI, nominated by appropriate authority, shall also be in touch with the appellant on a daily basis,” the Court said, while clarifying that no further extension of the interim relief will be given to Sengar.
On December 10, Sengar was granted interim bail for 10 days on medical grounds. On December 20, a coordinate bench had said that no further extension shall be granted to him and asked him to surrender before the jail superintendent on January 20.
