The Delhi High Court has recently asked the Delhi Government's forest department and Delhi Police to evolve a mechanism for rescuing the distressed birds in the national capital.
A division bench comprising Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela was dealing with a PIL filed by Save India Foundation seeking issuance of directions to the authorities to take immediate action for rescuing distressed birds.
The Court observed that the measures which need to be taken to rescue the distressed birds in the national capital primarily are the responsibility of the Department of Forests and Wildlife and Delhi Police.
The Bench directed the petitioner- Save Indian Foundation, to make an exhaustive representation to the appropriate authorities of the Delhi Police as also of the Department of Forests and Wildlife.
The said representation has been directed to highlight the instances raised about the birds in distress and also for making suggestions for evolving an appropriate mechanism and for taking such measures as may be required.
The Court directed that when such representation is moved, the same shall jointly be considered by the officials of the Department of Forests and Wildlife and the Delhi Police.
“That while considering the prayers/suggestions to be made by the petitioner-Save Indian Foundation in its representation which is to be made under this order, the Officials of respondent No. 1-Department of Forests and Wildlife, GNCTD and the respondent No. 3-Delhi Police shall evolve an appropriate mechanism for taking requisite measures for rescuing the distressed birds in NCT of Delhi,” the Court said.
It added that the requisite mechanism shall be evolved after due deliberation on and consideration of the suggestions or prayers to be made by the petitioner organisation, with expedition within three months.
“That the Officials of respondent No. 1-Department of Forests and Wildlife, GNCTD and Respondent No. 3-Delhi Police while taking decision under this order shall also seek cooperation and consultation with any other expert body, such as Animal Welfare Board of the Government of Delhi,” it said while disposing of the plea.
