The Delhi High Court on Wednesday sought empirical data on a petition seeking to supervise and monitor the progress of cases relating to complaints of cheque bouncing under Section 138 of the Negotiable Instruments Act.
Section 138 of the NI Act deals with dishonour of cheques for insufficiency of funds in the account.
A division bench comprising Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela was dealing with a public interest litigation filed by one Shivani Pal.
It was her case that long dates are given in cheque bouncing cases which lead to unnecessary and undue delay in disposal of such cases.
The Bench found that the concern raised in the PIl may need attention of the Court on the administrative side.
However, it added, that for entertaining the petition, some empirical data needs to be furnished by Pal to substantiate the submissions made in the matter.
The Court then granted four weeks' time to Pal's counsel to file an additional affidavit bringing on record the empirical data for substantiating the averments made in the petition.
The matter will now be heard on March 28.
