The Delhi High Court has directed the Delhi Government to constitute Delhi Pharmacy Council within two weeks, as a last and final opportunity.

Justice Prathiba M Singh was dealing with a plea moved by members of the Delhi Pharmacy Council. concerning notifying the results of election of the Council held on November 02, 2021.

“Considerable delay has already taken place in the constitution of the Delhi Pharmacy Council. The writ petition itself relates to notifying the results of election of the Delhi Pharmacy Council held on 2nd November, 2021. Since the newly elected body now stands notified, the Respondent No. 1-GNCTD shall constitute the Delhi Pharmacy Council within two weeks as a last and final opportunity,” the court said.

Last month, the Court had observed that stark differences existed between the number of votes polled and the table mentioned in the notification of election results.

The court was informed that the corrected notification has been issued by the Delhi Government on October 12.

“A copy of the notification dated 12th October, 2023 has been placed on record. The concerned official further submits that the file is now before the Hon’ble Lieutenant Governor,” the court noted.

The petition was disposed of in February and it was directed that the results of the election shall be declared within three weeks and it was observed that escalation of files within government departments, cannot be a ground for delay.

Later, an application was moved seeking directions to constitute the Council as the same was not constituted and there were mistakes in the notification of the result by the Delhi Government.
