Delhi High Court Initiates Contempt Proceedings Against SpiceJet For Failure To Return Aircrafts And Engines To TWC Aviation

The Delhi High Court on July 09 initiated contempt proceedings against SpiceJet for its failure to fulfil the order of the Court requiring the airlines to hand over two Boeing aircrafts and three engines to TWC Aviation.

The Division Bench of Justice Rajiv Shakdher and Justice Amit Bansal were dealing with the suit filed by TWC Aviation, owner of the aircrafts and engines, seeking permanent injunction against SpiceJet over unpaid dues.

The appellant (SpiceJet) stated that they had substantially complied with the order by positioning two engines and one aircraft in Delhi for delivery to the respondent (TWC Aviation). They were yet to transfer one more engine and an aircraft frame.

The High Court noted that SpiceJet has not completely complied with the order. In view of this, the Court ordered the Registry to register contempt petition against the directors of SpiceJet. It ordered SpiceJet's counsel to provide names of the directors.

“Issue notice to the appellant as to why contempt proceedings ought not to be taken up against the directors of the appellant company… The Registry will register a contempt petition against the directors of the appellant once the names are furnished.”

The matter is listed on July 19.
