Delhi High Court Directs Its Administration To Ensure All Commercial Courts Are Made Fully Functional As And When Infra, Judges Are Available

The Delhi High Court has directed its administration to ensure that all the Commercial Courts in the national capital are made fully functional as and when the infrastructure and judges are available for such courts.

A division bench of Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula disposed of a PIL moved by Advocate Amit Sahni seeking setting up of the Commercial Courts in terms of a 2021 decision taken by the Delhi Government’s cabinet for creation of 22 Commercial Courts and 42 additional posts of judges.

The bench said that there is certainly an improvement in the matter of establishment of Commercial Courts in Delhi and and that steps are being taken up to fill up of the remaining posts of District Judges.

“With the aforesaid, the PIL stands disposed of. However, it is made clear that the High Court shall ensure that all the Commercial Courts are made fully functional as and when the infrastructure is available and Officers are available to be appointed to the post of District Judge, Commercial Courts,” the court said.

The bench was informed by High Court administration’s counsel that there are 46 Commercial Courts which are functioning in Delhi. It was also submitted that steps are being taken to ensure that all the 64 sanctioned posts of District Judges in such courts are filled at the earliest and that the process for filling up the vacant posts is ongoing.

“In view of the aforesaid, there is certainly an improvement in the matter of establishment of Commercial Courts and steps are being taken up to fill up of the remaining posts of District Judges, Commercial Courts, and therefore no further orders are required to be passed by this Court in the present PIL,” the court said.
