Can Rape Victim Who Contracted HIV Be Awarded Compensation Under Delhi Victim Compensation Scheme? High Court To Decide

The Delhi High Court is set to decide as to whether a victim of rape or sexual assault, who has contracted STD or HIV, be awarded compensation under the Delhi Victim Compensation Scheme, 2018.
Justice Sanjeev Narula issued notice on a woman's plea who was subjected to sexual assault in 2017, leading her to contracting HIV, seeking enhanced compensation under the Scheme.
She was awarded Rs. 1,75,000 as interim compensation by the Delhi State Legal Services Authority under the Delhi Victim Compensation Scheme.
She was also awarded additional interim compensation of INR 1,00,000 on November 11 in terms of a trial court order.
It was her case that the schedules under the Victim Compensation Scheme do not stipulate any provision for award of compensation specifically with respect to a victim contracting an STD or HIV as a result of the assault.
The Court issued notice in the plea and sought response of the Delhi Government and DSLSA.
The matter will now be heard on January 07, 2025.
