    The Bombay High Court on Wednesday (January 29) disposed of a suo motu PIL concerning the State Government's proposed 'cluster school policy'. 

    The Court had taken suo moto cognizance based on various newspaper reports which stated that to improve education across the State, the State government would merge smaller schools with bigger schools within the vicinity.

    During the hearing today, a division bench of Chief Justice Alok Aradhe and Justice Bharati Dangre noted that during the previous hearing, the Advocate General had stated that the State government was only in the process of gathering information and that it had not yet formulated any policy.

    Today, Advocate General Birendra Saraf reiterated the stand that the State government has not taken any policy decision on its proposal. The Advocate General orally remarked that the suo motu cognizance was taken on the impression that the State government had already implemented the policy.

    Taking note of AG's statement, the Court observed that no useful purpose would be served keeping the petition pending. It thus disposed of the PIL.

    The Court stated that it would be open to the State government to take any such policy decision and also granted liberty for such decision to be challenged if taken.
