    The Bombay High Court on Tuesday (January 14) issued notice to the Mumbai Police on a plea filed by Pradeep Nakhawa, the victim and husband of the deceased in the infamous Worli Hit-n-Run Case, who has sought invocation of murder charges against the prime accused Mihir Shah in the case.

    A division bench of Justices Revati Mohite-Dere and Dr Neela Gokhale heard brief submission in the plea filed through Advocate Dilip Satale, who urged the court that despite reminders and repeated requests, the police has not yet invoked section 103 of the Bharatiya Nyay Sanhita (BNS), which penalises murder.

    "Issue notice to the respondents. Make it returnable after a week," the bench said.

    According to Satale, his client wrote several letters and made repetitive requests to the officers investigating the case and even to the Commissioner of Police, Mumbai, for invoking murder charges against prime accused Shah.

    However, despite his client's requests, the police did not invoke section 103 and proceeded to file chargesheet in the case. He thereafter, once again wrote a letter with the similar request for invoking murder charges in the supplementary chargesheet. Since there has been no response, he petitioned the High Court.

    Notably, Shah, is the son of Maharashtra's former Chief Minister Eknath Shinde's close aide, Rajesh Shah. He was arrested on July 9, 2024, two days after he dragged a woman by his car while driving his BMW car, in an inebriated condition during the wee hours of July 7 in Mumbai's plush Worli area. The woman was Pradeep's wife and she died in the accident.
