    The Allahabad High Court last week came to the aid of a visually impaired candidate who could not apply for the All-India Bar Examination (AIBE)-XIX in time, admittedly due to an error in his 5th-semester examination result caused by his University.

    Though the University rectified the error and declared the candidate passed, the petitioner, due to the said error, could not submit the AIBE-19 form in time, i.e., before the deadline ended on November 15.

    In view of this, a bench of Justice Saral Srivastava directed the Bar Council of India to permit the petitioner to submit an application form for appearing in the AIBE-19 within 1 week and to allow him to appear in the AIBE scheduled for December 22.

    In brief, the petitioner (Navendu Aggarwal) moved the HC, inter alia, seeking quashing of his incorrect result of the 5th Semester Examination and to allow him to appear in the AIBE-19.

    When the matter came up before the Court, the counsel appearing for the petitioner submitted before the single judge that the petitioner's printout of the answers could not be inadvertently pasted on the examination copy.

    However, the bench was further told that the error had been rectified, the petitioner had been passed, and the correct marks sheet had been issued to the petitioner.

    Given this, the court decided to dismiss the writ petition as having become infructuous.

    However, when the bench was apprised that due to the error in his results, he could not submit the form of AIBE-19, the Court, considering the petitioner's bona fides and the BCI counsel's submission that the petitioner may file a fresh representation before the BCI, shall be considered sympathetically, the court issued the direction to the BCI as aforementioned.

    Advocates Avanish Tripathi, Akash Patel and Varun Singh appeared for the petitioner.
