    The Allahabad High Court has asked the Central Board of Secondary Education (CBSE) as well as the Uttar Pradesh Government to file a response in 10 days about the steps taken by them to control the "menace" of coaching institutes running in the premises of school/college buildings across the state.

    A bench of Justice Mahesh Chandra Tripathi and Justice Prashant Kumar made this enquiry while dealing with a writ petition filed by one Manish Kumar Mishra seeking a direction to respondents to ensure the strict compliance of UP Coaching Regulation Act, 2002 and CBSE Circular (of August 2019).

    Essentially, Mishra had moved the High Court contending that he is a member of a trust known as 'Janki Trust', which is running a school affiliated with CBSE. It was his grievance that in the vicinity of his institution, there are various institutions affiliated with CBSE and running coaching institutes in the premises of school/college buildings, which is contrary to the policy of CBSE as well as the U.P. Coaching Regulation Act, 2002.

    It was submitted by his counsel before the Court that he has made several representations to the authorities concerned in this regard, however, no action has been taken.

    Taking into account the facts and circumstances of the case, the Court directed that a response/counter be filed by the Secretary of the State Department concerned as well as the Secretary, CBSE, New Delhi apprising the steps being taken across the State for controlling such menace. The Court will hear the matter next on August 14.

    Our readers may note that CBSE's 2019 Circular as as well as the 2002 act of the State prohibit the running of coaching institutes within the premises of school/college buildings. CBSE has specifically warned the affiliated schools against running commercial activity from their premises. The circular was issued by the CBSE after it received complaints about several schools of running parallel coaching centres on their premises during school hours to prepare students for entrance and competitive exams.
