Allahabad HC Refuses Relief To YouTuber Mridul Madhok Accused Of Body Shaming, Defaming Fitness Influencer Kopal Agarwal

The Allahabad High Court last week rejected a writ petition moved by YouTuber and Instagram influencer Mridul Madhok seeking quashing of an FIR lodged against him over allegations of body shaming, defaming and making false claims regarding fitness influencer Kopal Agarwal.
Observing that a cognizable offence was found to have been committed by Madhok after perusing the impugned FIR, the court rejected his petition.
A bench of Justice Sangeeta Chandra and Justice Om Prakash Shukla, however, clarified that if Madhok and Agarwal enter into a compromise, he may appear before the Investigating Officer along with the compromise, if any, occurring between the parties and the Investigating Officer may take appropriate decisions thereon.
Essentially, the FIR against Madhok, filed by Agarwal, has been lodged under Section 318 (4) [Cheating], 336 (3) [Forgery], 356 (2) (Defamation), 79 [insulting modesty of woman] BNS read with Section 67 [Punishment for publishing or transmitting obscene material in electronic form] IT Act and Section 63 [copyright infringement] Copyright Act.
For context, in her complaint, Agrawal has alleged that Madhok misused her pictures and identity in a misleading and defamatory manner on Instagram, wherein he posted a reel falsely claiming that she was her customer and that his fat burner supplement helped her lose weight.
Her complaint further alleged that Madhok used her before and after pictures without permission, violating her privacy and copyright. Furthermore, he also body-shamed me in the reel, causing her severe mental distress.
Madhok had moved the HC seeking quashing of the FIR and had also claimed that he got to know that Agarwal was ready for a compromise in the matter.
In view of this submission, the Court refused to entertain his plea while granting him theliberty to compromise the matter with Agarwal and approach the IO.
