Duty Of Police To Ensure Unhindered Movement Of Lawyers During Maha Kumbh: Allahabad High Court

The Allahabad High Court has observed that justice cannot be obstructed due to other contingencies and that obstructing the movement of lawyers due to Maha Kumbh impedes the process of justice.
Observing that a case posted for 10 am was adjourned twice because the lawyer could not reach the Court due to extreme traffic conditions in the city, Justice J.J. Munir observed
“While this Court understands that this is an unusual situation because of the presence of a large population visiting the Mahakumbh, it is the duty of the Police to ensure that movement of learned counsel to the Court is unhindered and does not affect the functioning of the Court. Any hindrance in the movement of learned counsel during Court hours impedes the process of dispensation of justice.”
The Court observed that special measures must be taken to ensure that the “functioning of justice” is not brought to a standstill.
With the aforesaid observations, the Court adjourned the case for a third time.
