It is the case of the victim that the accused made sexual relations with her on the false promise to marry her and that he never intended to marry her.
Before the High Court, the Counsel for the accused submitted that the marriage between the accused and the victim could not be solemnised as the victim is a Mangalik. Refuting this allegation, the Counsel for the victim submitted that she doesn't suffer from Mangal Dosha.
In view of the conflicting claims made by the parties, the Court directed the Head of Department (Astrology Department), Lucknow University to decide the matter as to whether the girl is a Mangali or not. The Court also directed the parties to produce their kundali before the HOD within ten days.
"The Head of Department (Astrology Department), Lucknow University is directed to submit a report in a sealed cover within three weeks to this Court," the Court directed.
