Allahabad High Court Grants Bail To Man Accused Of Strengthening PFI To Establish 'Gazwa-E-Hind' In India

The Allahabad High Court recently granted bail to a UAPA Accused (Muneer Alam) who was arrested in July 2023 on the allegations of actively participating in strengthening the Popular Front of India (PFI) organization to establish 'Gazwa-e-Hind' in India.
The Bench of Justice Attau Rahman Masoodi and Justice Saurabh Lavania granted him bail, noting that four co-accused have already been granted bail in connection with the same FIR.
The case in brief
The prosecution case, in brief, is that in September 2022, an FIR was lodged at a Police Station in District- Meerut to the effect that various Agencies including the Anti-Terrorist Squad, Uttar Pradesh had been receiving information that Popular Front of India and certain other Muslim Organizations were engaging themselves in Anti-National Activities with intent to divide and disintegrate India and establish Islamic State by 2047.
It was alleged that in Western UP, under the leadership of the State President of West UP of All India Imam Council and ex-member of PFI, Mohd. Shadab Ajeej, accused Maulana Sajid, Mufti Shahzad and Mohd. Islam Qasmi were actively participating in strengthening the aforesaid organization and establishing Gazwa-e-Hind in Hindustan.
All four accused were apprehended for investigation, and a charge sheet was filed against them in March 2023.
The appellant's name (Muneer Alam) came to light during the investigation based on documentary evidence. The PFI credited some amounts to the appellant's account. The appellant confessed that the said amount was used for anti-social activities.
Seeking bail in the matter, the Counsel for the appellant submitted before the HC that only based on documentary evidence had the appellant been assigned to be involved in anti-social activities.
It was contended that the confessional statement made before the police had no evidentiary value. It was strongly submitted that the charge sheet had already been submitted and that there was no likelihood of the investigation being affected.
It was also submitted that the Court has already allowed the appeal in similar matters and granted bail to the accused, Mufti Shahzad, Maulana Sajid, Mohd. Islam Qasmi and Mohd. Shadab Aziz Qasmi.
Against this backdrop, the Court granted bail to the appellant/accused.
