While hearing a case concerning an elderly couple aged about 75-80 who are involved in a legal battle over the issue of maintenance, the Allahabad High Court last week made an uncommon statement that it seemed that 'kalyug' has arrived.

A bench of Justice Saurabh Shyam Shamshery made this remark while hearing a petition filed by one Munish Kumar Gupta (husband) challenging a family court's order directing him to pay Rs. 5000 as maintenance to his wife (Gayatri).

While issuing notice to the wife in the matter, the Court listed the matter for a final hearing in the hope that the parties may reach a settlement.

According to the facts of the case, the Applicant (Munesh) was a IV-class employee in the medical department. In 1981, he built a house in the name of his wife, Gayatri Devi. Three years after the applicant retired, Gayatri Devi donated the house to their younger son in 2008, which led to a dispute between the elderly couple over the issue of the elder son being deprived of his rights.

Due to their dispute, the couple started living separately with their respective sons and the wife also filed a maintenance claim against the applicant in the family court. After the family court directed the applicant to pay Rs. 5000 as maintenance to his wife, he moved the High Court.
