Allahabad High Court Denies Relief To Choreographer Remo D'Souza In 2016 Cheating Case

Last week, the Allahabad High Court dismissed a quashing petition filed by Bollywood choreographer and Film Director Remo D'Souza in connection with a 2016 cheating case.
A bench of Justice Rajeev Misra dismissed his plea, noting that since D'souza had failed to challenge the chargesheet filed against him in the matter, no relief, as he had prayed for, could be granted.
“Having heard the learned counsel for applicant, the learned A.G.A. for State and upon perusal of record, this Court finds that the charge sheet dated 25.9.2020 submitted against applicant has not been challenged in the present application. In the absence of any challenge to the charge sheet, no relief as prayed for by means of present application can be granted,” the Court observed in its order as it dismissed his plea.
The case against D'Souza dates back to 2016 when an FIR was lodged against Ghaziabad businessman Satyendra Tyagi. The FIR alleged that D'Souza had suggested he invest Rs 5 crore in 2016 to finance his upcoming film, 'Amar Must Die,' with a promise that he (Tyagi) would receive double the amount (Rs 10 crore) after the film's release. However, he failed to do so.
The FIR lodged under Sections 420, 406, and 386 of the IPC also alleged that when the businessman asked for the money as promised, D'Souza threatened him by having underworld don Prasad Pujari call and intimidate him.
A court of A.C.J.M. III, Ghaziabad, took cognizance of the offence in October 2020.
D'Souza moved to the High Court to challenge the cognizance order and seek a stay on the case proceedings. However, when the counsel for the state submitted that he had failed to challenge the chargesheet in the case, the Court dismissed his petition.
