Hearing a Criminal Writ PIL plea demanding lodging of an FIR against the police officials involved in 'assaulting' lawyers in Prayagraj on February 4, the petitioner (Allahabad High Court Bar Association) filed before the HC a supplementary affidavit and Pen-Drive highlighting atrocities committed by the police personnel.
Pursuant to the High Court's previous order, the concerned Divisional Commissioner, Mela Adhikari, the Police Commissioner, the District Magistrate, and the Deputy Commissioner of Police (Traffic) also filed their respective affidavits, which were taken on record by a bench of Justice Rajiv Gupta and Justice Mohd. Azhar Husain Idrisi.
It may be noted that the High Court Bar Association wrote a letter to the Chief Justice highlighting that the police had prevented the lawyers from reaching the High Court and blocked the road for some VIP movement. It was stated that the police had assaulted the lawyers upon the latter asking for access to the road.
The Chief Justice directed that the letter be converted into a criminal Public Interest Litigation, which is now being heard by the division bench.
On February 14, Anil Tiwari, Senior Advocate appearing for the High Court Bar Association, Allahabad, argued highlighting personal atrocities committed by certain police personnel upon the practising advocates of this Court. He prayed for and was granted two days' time to file personal affidavits of the victims.
The counsel for the State also prayed for and was granted two days to file a reply to the second supplementary affidavit.
Posting the matter for hearing next on February 18, the bench directed that the Pen-Drive filed by counsel for the petitioner be kept in safe custody by the Registrar General of High Court, Allahabad, and to produce the same before the Court on the next date fixed.
