    A Student of the Aligarh Muslim University (AMU) has moved the Allahabad High Court challenging an FIR lodged for rioting, wrongful restraint and other charges over alleged indiscipline and misconduct during demonstrations to restore students' union polls.

    The petitioner, Misbah Qaiser, a B.Arch. Student at the university has been accused of delivering objectionable speeches against the administration, which allegedly provoked other students. As a result, the FIR alleges, they blocked the Vice Chancellor's vehicle and attempted to cause damage, allegedly intending to carry out a deadly attack.

    In his criminal writ plea, the petitioner claimed that on the date of the alleged incident, students in the strength of 100-125 went to raise their issues regarding attendance and upcoming exams, not for any illegal demands, and that the petitioner did not give any speech that instigated the students to agitate in a wrongful manner.

    The petitioner, represented by Advocates Ali Bin Saif and Kaif Hasan, contends that the FIR is nothing but an attempt to undermine the cause of students who were merely raising issues regarding exams and attendance.

    … on the one hand university has suspended petitioner and other named students and on the other hand university through its officials has also lodged a First Information Report against petitioner and other named students which clearly shows that present First Information Report is a clear abuse of process of law,” Qaiser's plea states.

    It may be noted that based on the alleged incident, the university has also suspended the petitioner and has barred him from entering the University campus and has ordered him to vacate his hostel on the campus provided by the university.

    The HC will hear the matter on February 11 (Tuesday.)
