Book Launch Of 'The Indian Makeover: From Being Ruled To Being Governed' By Dr. Justice G.C. Bharuka And Devashish Bharuka [8th December]

A book authored by Dr. Justice G.C. Bharuka, a former Judge of the High Courts of Patna & Karnataka and Devashish Bharuka, Advocate, Supreme Court of India, titled 'The Indian Makeover: From Being Ruled to Being Governed' is scheduled to be launched on 8th December 2023 (Friday) at 06:30pm.

The book will be formally released by Justice P.S. Narasimha, Judge, Supreme Court of India. Shri Tushar Mehta, Ld. Solicitor General of India is the Guest of Honour. Prof. (Dr.) C. Raj Kumar, Founding Vice Chancellor, O.P. Jindal Global University would be gracing the occasion as a Distinguished Academician.

About the book

Pre-independence, India (in fragments) had always been ruled – be it under the ancient kings or the Mughals or the British. The narrative of India from 'being ruled' to 'being governed' is an intriguing one with its own share of twists and turns. This book offers a glimpse into the era of 'the rule' prior to India's freedom and its post-independence normative transformation to 'governance' through constitutional democracy.

The Indian Constitution came to be adopted after undertaking a mammoth exercise of penning the draft document followed by intensely debated sessions in the Constituent Assembly between December 1946 and January 1950. During the discussions, the necessity of certain draft provisions came to be critically questioned. Some provisions were completely substituted on account of the experience gained between independence and the final adoption of the Constitution. And some were introduced for the first time as the debates progressed.

A constitution is treated as a living document. Post-adoption, the norms embedded in the Indian Constitution continue to evolve on account of Parliamentary interventions and judicial interpretations. The book is an attempt to capture some of these historical moments of constitutional significance followed by developments, which have enriched the norms of governance in India over the decades.

Shri R. Venkataramani, Ld. Attorney General for India has, in his Foreword to the book, noted that this is the 'first and an elegant attempt to capture what one may call constitutional movements which have laid down the framework and the foundations for Indian citizens to have participatory governance.'

About the authors:

DR. JUSTICE G.C. BHARUKA was a High Court Judge (1990-2003) at Patna and Karnataka High Courts. He also served as the Acting Chief Justice in the High Court of Karnataka. As a Judge, he undertook doctoral studies from the National Law School of India University, Bangalore and was awarded Ph.D. in 2003. His doctoral thesis was published as a book titled 'Rejuvenating Judicial System through E-Governance & Attitudinal Change', Wadhwa & Co. Upon his retirement, Dr. Justice Bharuka was appointed as the first Chairman of the E-Committee, Supreme Court of India constituted by the Government of India in 2005, where he was instrumental in framing the National Policy and Action Plan for Implementation of Information and Communication Technology in Indian Judiciary. This document formed the basis for implementation of information and communication technology in the Indian judiciary. Dr. Justice Bharuka was also a visiting faculty in National Judicial Academy, Bhopal and a member of the Governing Body of the Chanakya National Law University, Patna. He conceptualized and passionately worked on this book up until his unfortunate demise in New Delhi on 15.03.2018.

DEVASHISH BHARUKA is a Harvard Law School LL.M. graduate and a practicing lawyer in New Delhi, India since 2001. He was declared an Advocate-on-Record by the Supreme Court of India in 2006. In the year, 1994, he authored a book 'Judgment Locator of Patna High Court Cases (1950-1993)' and co-authored coursework on Dispute Resolution in Cyberspace for the Berkman Centre for Internet & Society at the Harvard Law School in 2000. Mr. Bhaurka is the Editor of the Pollock & Mulla, The Indian Partnership Act, 8th ed. published by LexisNexis in 2019. He is a life member and former Jt. Treasurer of the Supreme Court Bar Association as also a life member and former President of the Harvard Club of India.
