There Is No Guaranteed Right To Continue To Draw Ground Water For Commercial Purposes : NGT [Read Order]

"Ground water is scarce and not unlimited. There is no guaranteed right to continue to draw ground water for commercial purposes without any permission," the National Green Tribunal has observed while dismissing an appeal filed by M/s India Glycols Limited challenging an order of Central Ground Water Authority, directing stoppage of ground water withdrawal.
A bench led by Chairperson Justice Adarsh Kumar Goel said "The area is declared to be 'semi-critical' where the recouping of the ground water is not taking place to the extent of drawal and water level is depleting. In these circumstances, ground water cannot be extracted for commercial purposes. Industrial activity has to rely on treated water or harvested water."
The tribunal reffered to it's order in the case of Shailesh Singh Vs. Hotel Holiday Regency, Moradabad & Ors, in which it has taken a similar view to stop groundwater extraction
