In its resolutions dated February 12, the Supreme Court collegium has remitted the candidature of three Judicial Officers and one lawyer, to the respective high court collegiums.
The collegium comprising Chief Justice of India Ranjan Gogoi, Justice AK Sikri and Justice SA Bobde passed resolutions with regard to the following three high courts:
Calcutta High Court
The recommendation for appointment of Judicial Officer Rabindranath Samanta was remitted to the High Court collegium, as the Supreme Court collegium noted that several Judicial Officers senior to him had been ignored while making the recommendation.
The collegium had first considered his candidature in October last year, but had deferred the proposal. It now resolved, "On scrutiny of the material placed before us, it is observed that names of many Judicial Officers senior to Shri Rabindranath Samanta have been ignored. In our considered opinion, the above proposal deserves a fresh look by the High Court Collegium. The Collegium recommends that the same be remitted to the Calcutta High Court."
Madhya Pradesh High Court
The names of two Judicial Officers—Rajendra Prasad Sharma and Rajesh Gupta—were remitted to the High Court collegium.
Their names had first come up before the collegium in October last year, along with three other Judicial Officers. The collegium had, however, deferred their candidature. Relying on certain observations made by the Department of Justice with regard to the two candidates, the collegium now resolved, "For purpose of assessing merit and suitability of the above-named recommendees for elevation to the High Court, we have carefully scrutinized the material on record including the observations made by the Department of Justice in the file.
Having regard to all relevant factors, the Collegium is of the considered view that the proposal for elevation of S/Shri (1) Rajendra Prasad Sharma, and (2) Rajesh Gupta, Judicial Officers deserves to be remitted to the Madhya Pradesh High Court. The Collegium resolves to recommend accordingly."
Orissa High Court
The Supreme Court collegium remitted the candidature of Advocate Kali Prasanna Mishra to the Orissa High Court.
Advocate Mishra was considered for elevation in October last year as well, along with seven other Advocates. The collegium had, however, decided to consider his name after some time.
Vaguely relying on the material on record, it now resolved, "For purpose of assessing merit and suitability of Shri Kali Prasanna Mishra, Advocate, for elevation to the High Court, we have carefully scrutinized the material on record including the observations made by the Department of Justice in the file. Having regard to all relevant factors, the Collegium is of the considered view that the above proposal deserves to be remitted to the Orissa High Court. The Collegium resolves to recommend accordingly."
