After complaints and suits filed by NCB officer Sameer Wankhede, his father and cousin, against NCP leader Nawab Malik posts, the officer's elder sister – Yasmeen Wankhede - has approached the Andheri Metropolitan Magistrate's court alleging stalking and defamation.
The criminal complaint filed under section 200 of the CrPC seeks direction to issue process, and to try and 'suitably punish' Malik under sections 354D, 499, 500 and 509 of the IPC related to stalking, defamation and insulting a woman's modesty.
"…by posting/publishing the tweets and making false and defamatory remarks against the Complainant in the televised interviews, the Accused has defamed the Complainant's image, prestige and reputation," the complaint filed through advocate Vivek Pandey read.
Wankhede specifically took exception to Malik referring to her as 'lady don' while reposting her picture with a 'regular' Narcotics Control Bureau panch witness – Fletcher Patel. However, she says that Malik continued to call her lady don in several of his interviews after that.
The Advocate states that she has not consented to Malik using her picture. And to get her picture, Malik has 'stalked' her on the internet and therefore committed an offense under section 354D of the IPC.
"The said picture apart from being illegally taken from the internet has only been used for an unlawful purpose of defaming her by insinuating that she has indulged in some kind of extortion at Maldives," the complaint states.
On November 2, Malik posted another tweet claiming it was a chat between Wankhede and a drug peddler. "The tweet is defamatory and false," according to Wankhede.
She said that many people who know her had made enquiries with her regarding the tweets posted/published and statements made by Malik in the televised interviews.
Wankhede states her brother was handling Malik's son-in-law Sameer Khan's illicit drugs case, and the latter was recently granted bail. "Out of the personal grudge and vengeance held against the Complainant's brother Malik started making false, defamatory and baseless allegations against her and her family," she alleged.
Wankhede further said that Malik took advantage of the fact that Sameer arrested Aryan Shah Rukh Khan, which drew much media attention. Therefore, Malik is tainting her and her family's image and is levying several false, baseless and defamatory and derogatory allegations for personal vengeance.
In a defamation suit before the Bombay High Court, Sameer's father Dnyandeo Wankhede, has sought a temporary and permanent injunction against Malik, or anyone acting on his behalf, from posting "defamatory" remarks against them and Rs 1.25 crore in damages.
Yesterday, the Nagpur Bench of the Bombay High Court stayed the notice issued to Malik in an atrocities complaint filed by NCB officer Sameer Wankhede's cousin.
