    Supreme Court will continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

    Yesterday, Senior Advocate Kapil Sibal has drawn the court's attention towards the issue of collaboration of the key functionaries of the State with the accused persons, referring to the documents submitted by him along with the Protest Petition. It was his submission that the SIT did not make investigations regarding the collaboration and the allied issues, when there was evidence before it.

    During the course of four days until today, Mr. Sibal contended that the Special Investigation Team had neither looked into the reports by the National Human Rights Commission, Election Commission, or the Committee on Empowerment of Women set up by Parliament with respect to the Gujarat riots nor did they examine the members of such commissions. He also demonstrated the flaw in SIT's stand that there was no violence or arson.

    SIT has not challenged the Gujarat High Court's decision to acquit Maya Kodnani, former BJP MLA from Naroda, who was identified as the 'kingpin' in the Naroda Patiya massacre of 2002 by the trial court, Mr. Kapil Sibal argued hinting at the political optics of the SIT not challenging the High Court order. Senior Advocate Kapil Sibal told the Supreme Court that the SIT head RK Raghavan was appointed as a High Commissioner later, and all these people who 'collaborated were rehabilitated later.

      Sibal: Even the constitution is printed words. In the cold print lies the soul of the constitution. You through your pronouncements give it energy, it will come alive, it will not remain dead letter. It is only this court that can give energy to that cold print.

      Sibal: On 27.02.2002 you knew yet no action taken. Kindly come to the Guj. Police Manual on preventing violence. Yesterday I read a judgment how a Manual is to be followed and because it was not how the intent of the Investigating agency was suspect.

      Sibal: Kindly see Rule 45 - Maintenance of order. Then Rule 46. [Reads out the provisions];

      Sibal: Then, Milords, come to para 53, preventive measures to be taken during threatened communal incidents. (Sources of Intelligence to be kept on alert, smallest incident to be reported, nipped in the bud) - This was not investigated, why action was not taken. No investigation.

      Sibal: [Message asked to] Keep police bandobast. Then how did 3000 people gather there. Those were not days of WhatsApp. Then milords kindly see item 11, the wireless message.

      Sibal: Item 9 on preventive action to be taken at Gandhinagar. Gandhinagar was being warned throughout. So this was anticipated. To prevent mob violence only anticipation works. It is a horrendous tragedy that had happened.

      Sibal: Had curfew been declared at night itself, and enough force deployed to see crowds don't gather. None of this would have happened.

      Sibal: Incident of killing..all started (on 27.02.2002). These are all fax messages sent from various parts of the State to Gandhinagar about the problems that is going to arise.

      Sibal: These are translated by us. SIT did not translated them. We have given the Gujarati versions also. I don't know how SIT read it. Mr. Raghavan was there, they did not know Gujarati.
