Sibal: Now we're talking of discretion of the governor post the formation of an elected government. If post the formation, 10 people go to the governor, what is his discretion?

Sibal: Under the constitution, there are areas where governor has discretionary powers- subject to three conditions as per Nabam Rebia.

Sibal: Then I come to the governor's decision. Come to Chapter IX. This is an issue that has arisen for the first time. 

Sibal: To say that I have 40 members and now I can do what I like and I can remove you- that's unthinkable! He has per se voluntarily given up the membership of the house.

Sibal: The chief whip is the eyes and ears of the leader of the party.

Sibal: He has no choice in the matter. The party will decide. Who is the party? The leader. In finance, who leads the debate in Rajya Sabha - Mr Chidambaram. Who takes the decision? The party.

Sibal: This in essence tells you what the contours of the MLA in the house should be and in what circumstances he can disobey- one, he can take permission of the leader; two, he says something contrary to whip and party condones it.

Sibal: "The membership of the house doesn't become his private property nor can he trade in it." Look at these words. I am sure he wasn't in Assam for cleansing his conscience. There were bigger issues to be dealt with in Assam.

Sibal: You knew the ideology, you knew he was paksh pramukh, you took his ticket, then suddenly you're in Assam and you say you're very worried.

Dr AM Singhvi: A very left leader said that lawyers, doctors- should not be in parliament. We told him- you want parliament to only have unemployed people.
