A bench comprising Chief Justice of India DY Chandrachud, Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha is hearing the matter.
A 3-judge bench comprising CJI DY Chandrachud, Justice PS Narasimha and JB Pardiwala will separately hear at 3.30 PM the petition filed by Uddhav Thackeray challenging the decision of the Election Commission of India to allot the official name and symbol of Shiv Sena to Eknath Shinde group.

CJI DY Chandrachud: Any further action is not based on EC order. Then you have to pursue other remedies of law.
CJI DY Chandrachud: Something which is a part of the order we can decide upon. We cannot stay an order at this stage. They've succeeded before the ECI.
CJI DY Chandrachud: Does this order any issues concerning bank account, property etc?
Sibal: No but tomorrow they can say that they're the party and they can take over.
CJI DY Chandrachud: Counter affidavit be filed within 2 weeks. Pending further orders of this court, protection granted in para 133 (IV) of ECI order shall continue to remain.
CJI DY Chandrachud: Alright, issue notice.
Sr Adv Devadatt Kamat: The ECI has given us Shiv Sena (Uddhav Balasaheb Thackeray) and symbol flaming torch till bye elections, 26th Feb. That arrangement should continue till your lordships are hearing the matter. My political activity will come to standstill otherwise.
Sibal: Bank accounts, properties, occupations, that is with us.
CJI DY Chandrachud: They're saying that they won't do anything of that nature.
Sibal: There are other things they can do in terms of the bank account.
CJI DY Chandrachud: Mr Kaul, if we take this after two weeks, are you in the process of issuing a whip or disqualifying them?
Kaul: No.
CJI DY Chandrachud: So we'll record your statement.
Dr AM Singhvi: Tomorrow if they issue a whip or letter, if we don't do it, we'll be disqualified. Now they're the party- i have no protection. Your lordships should give that status quo atleast.
