The President of the Eid Miladunnabi (Central) Committee of Ahmedabad has moved the Gujarat High Court challenging the alleged inaction of the state police to grant its nod to the Eid-e-Milad procession proposed for 9th/10th October.
In its plea, the Petitioner [Parvez, the president of the Eid Miladunnabi (Central) Committee] has averred that the committee's representation to take out the procession is pending before the local police authorities, and their inaction to grant nod to the Juloos is violative of Articles 14, 19, and 28 of the Constitution of India.
The plea further states that the petitioner committee has already received a nod from the Ahmedabad Municipal Corporation and it has made necessary arrangements to take out the processions, however, since their application made to the local police authorities in this regard has not been rejected/accepted, therefore, they are moving the instant plea.
It has been stated in the plea (moved through Advocate K.R. Koshti) that the committee has been taking out the procession of Eid-e-Milad for the last 40 years, and due to the COVID-19 situation, it couldn't do so in the years 2020 and 2021. The plea also submits that in the year 2018, the local police authorities had refused permission for the Juloos without hearing the petitioner, however, in the year 2019, the High Court had allowed its plea to take out the procession.
Against this backdrop, the plea challenges the alleged inaction of the local police authorities and thus, seeks a direction from the Court to direct the respondent authorities to submit the status report in pursuance to the application filed by the petitioner seeking permission to take out the procession either on the 9th or 10th of October.
