The Supreme Court will hear at 3 PM today petitions seeking review of the 'Vijay Madanlal Chaudhary' judgment which upheld the powers of the ED & PMLA provisions.

A bench of Justices SK Kaul, Sanjiv Khanna & Bela M Trivedi will hear the matter.

Earlier, in August 2022, while issuing notice on the review petition, a bench led by the then CJI NV Ramana had observed that two aspects of the judgment prima facie required reconsideration - one, the finding that the copy of the Enforcement Case Information Report (ECIR) need not be given to the accused; two, reversal of the presumption of innocence.

    • 18 Oct 2023 10:36 AM GMT

Bench : We will fix one day for hearing, with half session to each party.

SG : But we will address the preliminary issue first.

Justice Kaul : You do it together.

    • 18 Oct 2023 10:35 AM GMT

Bench : The other preliminary objection raised by the respondents that in view of the order in review, any further consideration should await that.

It is also accepted by the petitioners is that what they seek is reconsideration of the judgment on certain parameters.

Bench dictates order : We have spent some time on the matters. We would like to lay down the path for determining the controversies in the matter. We note the same as.

      1. We will be addressing only the issues relating to PMLA.

      2. We note the objection of the Solicitor General that an academic exercise should not be carried out and there should be an issue and merely because someone approaches the Court that the judgment should be revisited, it should be revisited.

    • 18 Oct 2023 10:30 AM GMT

Justice Kaul : I am also of the view that things can be argued pleasantly. Keeping things light will help. And,no one can control my court.

    • 18 Oct 2023 10:27 AM GMT

Justice Kaul : Registry has prepared a chart about the petitions, its quite comprehensive. We can circulate..

    • 18 Oct 2023 10:24 AM GMT

Justice Kaul : Solicitor's view is that everybody can't come and say this judgment is wrong and that there should be a lis.

Sibal : We will give the matters where the issues arise.

    • 18 Oct 2023 10:23 AM GMT

Justice Trivedi : In that case, review petition is also to be listed along with this.

Justice Kaul : It is the Chief Justice's prerogative. CJ could have posted its together. It is for him to call.

    • 18 Oct 2023 10:23 AM GMT

Justice Kaul to Sibal : Another issue they have raised, which is the petition you are arguing? There can't be so many petitions. You have to show there are issues for reference to the larger bench and that this need not wait for the review petition.

    • 18 Oct 2023 10:22 AM GMT

Sibal : Another issue, assume offence takes place in one place, say Karnataka and money laundering takes place there. But one part, say bank account is in Delhi. So the entire case is shifted to Delhi..

ASG SV Raju interrupts. Justice Kaul expresses displeasure at the interruption. "We control the court", judge says.
