    The Supreme Court is hearing today an application seeking the uploading of Form 17C data on the ECI website and the publication of booth wise voter turnout data.

    A vacation bench of Justices Dipankar Datta and SC Sharma will hear the matter. The application has been filed by NGO Association for Democratic Reforms (ADR). A writ petition filed by TMC leader Mahua Moitra in 2019 alleging discrepancies in the voter turnout data of the 2019 General Elections is also listed today along with it.

    The ECI has opposed the application stating that there is no legal mandate for the general public to access Form 17C. The ECI stated that as per the Conduct of Election Rules, Form 17C can be given only to the polling agent of the candidate. The ECI also said the uploading of Form 17C on the website can lead to "mischief" and confuse the voters leading to mistrust in the process.

      J Datta: (referring to Prayer A of application) How can you expect relief which was the final prayer in the WP? How can you? .........we can grant , but only in very rare situations....why did you not come up with this application in March? why on 26th April ? please read out prayer B...we are trying to ascertain whether at all we should grant you relief

      J Datta: prayer A in your application is prayer B in the WP,can that be the interim relief ?

      J Datta: today is a suit is filed, then there are subsequent developments, if the court feels that these developments are to be applied then what is the procedure? is it different for WPs

      J Datta: what is the nexus between 2019 and 2024 application? why didn't you file a separate WP?

      Maninder : this WP is 4 years old, filed in 2019....was it permissible for you (ADR) to file an application on a judgment where you are a party....the trust is to be strengthen in the election process, not to be punctured

      Maninder: the ECI, take steps on its own wherever it thinks fit, it came to the conclusion that these applications are merely apprehensions

      J Datta: what is the prayer in your application (to ADR)

      Maninder: the WP , SC held was not maintainable, the same day when the judgement is delivered in the morning, the application is being churned by the factory again

      Maninder : why should this application be entertained? all the canons of law being put aside - resjudicata, delay in filing etc

      Maninder submits that the present application is only based on apprehension and suspicion which are misplaced grounds as already decided in the EVM -VVPAT judgement.
