The Supreme Court is hearing a batch of petitions seeking to criminalise marital rape.
The petitioners challenge Exception 2 to Section 375 of the Indian Penal Code and Section 63 of the Bharatiya Nyaya Sanhita which provide that sexual intercourse/sexual acts by a man with his wife would not be "rape".
A bench comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Manoj Misra is hearing the matter. Today is the first day of hearing. The bench started the hearing on October 17 (report about that can be read here).
