LAST FEW HOURS TO REGISTER! Deciphering The New Criminal Laws (BNS, BNSS & BSA): Exploring Changes And Beyond

In 2020, the Government of India embarked on an ambitious exercise of reforming the Criminal Justice System. To carry on this task of overhauling the criminal justice system, the Ministry of Home Affairs had initially sought suggestions from various stakeholders including the then Chief Justice of India, Chief Justices of all High Courts, Bar Councils and Law Universities, it subsequently formed a committee in March, 2020 under the Chairmanship of Vice Chancellor, National Law University, Delhi. While the constitution of the committee, the timing of the reforms (that coincided with the outbreak of Covid-19 pandemic) and the subsequent modalities adopted by the Committee came under scathing criticism from various quarters, the committee submitted its report to the Government in February, 2022 with its recommendations.

In a purported attempt to decolonise the criminal justice system, the Home Minister on 11^th August, 2023, introduced three bills titled Bharatiya Nyaya Sanhita (BNS), 2023, Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 and Bharatiya Sakshya Bill (BSB), 2023 seeking to repeal and replace the Indian Penal Code (IPC), 1860, the Code of Criminal Procedure, 1973 and the Indian Evidence Act, 1872 respectively.

Despite the clamour for wider public and expert consultations, the controversy on the Hindi nomenclature and a demand to send the bills for Joint Parliamentary Committee, on 18^th August, 2023 the bills were referred only to a Parliamentary Standing Committee on Home Affairs for examination. On the basis of the reports of the Parliamentary Standing Committee on Home Affairs [246^th, 247^th and 248^th Report], a revised version of the three bills was introduced in Lok Sabha on 12^th December, 2023. In the absence of the opposition members due to their suspension from the Parliament at that time, the three key Bills were passed by both the Houses of Parliament without any discussion or debate. Following the President's Assent on 25^th December, 2023 the bills became the law that would decide the future course of criminal justice system in the country. However, the implementation of the three laws was postponed to a future date- 1 July, 2024. With the Supreme Court of India junking the challenge to the new criminal laws and the date of implementation fast approaching, it is very important to understand the key changes brought by the new Acts.

About the Course:

This short course of 16 hours. It endeavors to unpack the important changes brought in by the new criminal laws and their impact on civil liberties. A mixed pedagogy will be adopted by the faculty members to instill critical thinking amongst the participants. The course will familiarize the participants with what has changed and what remains the same under new laws. Specifically emphasis will be laid on :

New forms of punishment like community service, forfeiture of property, extra-territorial operations of certain offences, revival of certain old offences like: punishment for murder by life-convict, sedition in new form- imputations, assertions prejudicial to national integration stringent penalties for certain offences, new offences- organized crime, petty organized crime, terrorism, snatching, changes to sexual offences, changes to procedural law: pre-trial and trial procedures, new procedures for trial of offences against proclaimed offenders, attachment of property, bail provisions and changes to the evidence law especially electronic records.

Course Objectives:

1. To familiarize the participants with important changes brought to new substantive and procedural criminal laws.
2. To enable the participants understand the impact of implementation of new criminal laws and the relevance of the existing criminal laws on interpretation of new laws.
3. To enable the participants reflect critically on the decolonization plank of new criminal laws.

Who can register for the course:

Ignorance of law is no excuse! With the new Criminal Acts having extra- territorial operation in some instances, anyone and not just People of India are welcome and eligible to attend the course. However, it will be most beneficial for Police Personnel, Lawyers and Law Students.
