NEET-UG 2024 : Supreme Court Refuses To Stall Re-Test For Candidates Whose Grace Marks Were Revoked

The Supreme Court on Thursday (June 20) refused to stay the re-test scheduled on June 23 for the 1563 candidates who were granted grace marks in the NEET-UG 2024 Exam. After revoking the controversial decision to award grace marks to these candidates, the National Testing Agency gave an option of re-test to them.
Challenging the decision of the NTA to give the re-test option to those candidates, a writ petition was filed, which was considered by a vacation bench comprising Justices Vikram Nath and SVN Bhatti today. While the bench agreed to issue notice on the petition, it refused to stay the re-test.
The counsel for the petitioner argued that the re-test was contrary to the rules. If the re-test is not stayed, the NTA will use the argument of "fait accompli", he submitted. However, the bench was not persuaded and posted the petition along with connected petitions to July 8.
The NTA's decision to grant grace marks was based on the fact that certain candidates were deprived of their full time on the date of the exam. However, this decision ran into controversy and several petitions were filed in the Supreme Court challenging it. Meanwhile, the NTA constituted a committee to review the decision. The committee formed the view that the decision to award grace marks to candidates for all attempted questions was anomalous as such compensation had to be restricted only to the unattempted questions. Based on the recommendations of the committee, the NTA decided to revoke the grace marks allotted to 1563 candidates. They have either the option to accept the original marks without the grace marks or to appear for the re-test.
