    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

     Taking the Court through a range of voluminous documents and notes, Senior Advocate Kapil Sibal concluded his arguments on behalf of the Petitioner yesterday. Senior Advocate Mukul Rohatgi will argue for SIT today,

    On Tuesday, Senior Advocate, Mr. Kapil Sibal appearing for the Petitioner, vehemently argued that the SIT that had given clean chit to the highest functionaries of the State of Gujarat, who were alleged to have been involved in the Gujarat riots of 2002, did not conduct proper investigation and the Magistrate and the Gujarat High Court did not deal with crucial material, refusing to delve further into the matter.

      Rohatgi: Shukla made 2 reports, so there were 3 in total. Shukla report 1 is 17.11.2010 and Shukla report 2 is 25.04.2011

      Bench: So in total 3 reports.

      Rohatgi: 08.02.2012 final report. This report accepted by court and protest rejected.

      Bench: Was it the same report or a new report?

      Rohatgi: Same report. Malhotra gave report to SC in 2010 and directed further investigation. Shukla investigated further and in 2011 he gave report to SC. Then both the reports were combined and given to Magistrate.

      Bench: The supplementary chargesheet pre-SIT was by state?

      Rohatgi: Yes. Item 6 is post SC order.

      Bench: Date of Closure Report can also be provided here.

      Rohatgi: 08.02.2012 in Gulberg case. Filed on same day before Magistrate who took cognisance in Gulberg.

      Rohatgi: I will get the date of judgement and when FIR was filed by SIT.

      Rohatgi: Now in this background, your lordship have the chart. This will show what the SIT did in 9 cases. Pre SIT 48 accused, 6 charesheets. Post SIT added 26 accused and added 6 more chargesheet. 24 convicted, 17 appeals in HC and they are pending. Qua Gulberg this is.

      Rohatgi: Our job was to see if there was further material against people who are not already accused or whether I should filed further chargesheet. That was my limit. My limit is circumscribed by the complaint.

      Rohatgi: While this Patel in Sr. No. 29 who was a Minister, joined BJP in 2002. He had nothing to do with the incident. The Third is the doctor. They have confused it.

      Rohatgi: Today Vol 6 is devoted to his statement. Shreekumar filed 8 affidavits before the Nanavati Commission. Then it goes on and on. Item 15 is Tehalka, then the DM giving instruction to the Mamlatdar.

      Rohatgi: Item 51 and 52 is a statement of Bhat. Sr. No. 29 Statement of Anil Trivuban bhai Patel. There are three Anil Patels and your lordships may note, the person that was stung by operation he was Anil Shankar Bhai Patel, a VHP supporter.

      Rohatgi: Kindly come to pg 16 of the note. These are the name of the persons who were examined in the enquiry by Shukla and Malhotra. Sr No. 1 is Zakia, Sr No. 2 is a co-petitioner in the SC. Mark the statement of Rahul Sharma.

      Rohatgi: Your lordship may note here, my friend read extensively from his statement. I will show that it is a travesty of justice that in the complaint he is an accused.
