Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar will take up the part-heard matter for further hearing. Senior Advocate Mukul Rohatgi for SIT will continue his arguments today.
Recapitulating his submissions so far, Senior Advocate, Mr Mukul Rohatgi, highlighted that the Petitioner is relying on the affidavits, testimonies of three-star witnesses namely, Shreekumar, Rahul Sharma and Sanjiv Bhatt. As per Mr Rohatgi, the complaint is replete with the statements made by these witnesses in affidavits before the Nanavati Commission.
Yesterday, referring to the order of the Supreme Court dated 12.09.2011 as the 'pole star', Mr Rohatgi reiterated that the remit imposed on SIT was to 'look into' the complaint of Zakia  in order to find additional material in the Gulberg matter

Rohatgi: See 353 top. He[TC] is making a comment that this lady had knowledge about Gulberg, information about other incidents like buildup and all, she got from Petitioner no.2

Rohatgi: The Court has done much more.

Rohatgi: [With respect to protest being taken as complaint] He [TC]says I will not take it as a fresh complaint. Because SC had said look into and the report was accepted by SC.

    • 2 Dec 2021 12:27 PM IST

Bench: You can give a breakup of the page numbers. Broadly, we get your concern, that you have investigated and placed material before judge and he had considered it.

    • 2 Dec 2021 12:27 PM IST

Rohatgi: Then, roles of individuals. For example, at 330 Shivanand Jha, APC. It is argued and analysed. [TC conclusion] He says whatever SIT had said is correct. Then, about Pandey, Tandon and Gondia.

    • 2 Dec 2021 12:22 PM IST

Rohatgi: Now, PC Pandey. He [TC] says only on the basis of call details, argument of conspiracy is not made out.

    • 2 Dec 2021 12:21 PM IST

Rohatgi: Then, rehabilitation of victims. This has nothing to do with SIT, but still it went into it. Again CD of Rahul Sharma comes in. Again the 3 star witnesses, One gave false register, one gave false CD and one lied about being present at the meeting of 27.02.2002

    • 2 Dec 2021 12:17 PM IST

Rohatgi: Now PPs sympathetic to VHP. The SC gave power to SIT to change PP. Full power was given.

    • 2 Dec 2021 12:17 PM IST

Rohatgi: Many of these points were actually irrelevant for us. The moment a new Govt. comes there is a new panel. You can call it favouritism, but that is how it is.

    • 2 Dec 2021 12:16 PM IST

Rohatgi: Then there was Gujarat bandh. This is actually irrelevant. Nothing that SIT had to do. Then harassment of officer. SIT examined which officer transferred where etc.

    • 2 Dec 2021 12:16 PM IST

Rohatgi: Only one portion I’ll read. [TC says] The Court cannot direct further investigation in the said proceeding. This part is corrected by HC. There is no appeal by Govt or SIT on this - if this was correct or not. I wanted to show this.
