    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar will take up the part-heard matter for further hearing. Senior Advocate Mukul Rohatgi for SIT will continue his arguments today.

    On the last occasion, Mr Mukul Rohatgi, appearing on behalf of SIT, vehemently controverted the submissions of the Petitioner that the SIT was trying to shield someone or something. He argued that on the contrary, the details in the Closure Report demonstrate the extent to which the SIT went to in order to conduct the investigation in the matter, keeping in view and often exceeding the mandate of the Supreme Court.

    Mr. Rohatgi had also apprised the Court that the Petitioner had made serious allegations against the then Chief Minister of Gujarat with respect to delay in requisitioning of the army. However, after investigation, the SIT found out that, on the contrary, the army was called in within the first three hours of the riots. Replying to the contention, Kapil Sibal noted that he hasn't mentioned about Chief Minister, but if Rohatgi continues reading it, then he will have to deal with the same.

      Rohatgi: The complaint has gone out of the hands of the complainant. I will show the complaint, which was by a semi-literate. SIT has not considered NHRC. Closure report discusses. Evidence before NHRC can be used in criminal proceedings.

      Bench: You said SC and HC commended the work of SIT. Can you give the date of the orders?

      Rohatgi: 01.05.2009 reported as (2009) 6 SCC 767.

      Rohatgi: I misinterpreted. Your lordship is talking about the court where closure report filed and not where the trial was going on. Your lordships, the court after application of mind accepted the closure report.

      Bench: All that we said is that we will consider your arguments for rejecting the plea of other side. But we have to deal with what the Court said with respect of closure report.

      Rohatgi: To answer your lorships, if something is wrong with a court judgement that is redressal by a legal system. It is not redressable by filing a complaint in a parallel fashion.There cannot be 3-4 parallel things going on. We have prosecuted Maya Kodnani, a sitting Minister.

      Rohatgi: I placed. My role was to prosecute people. I have done my job. This (Zakia’s complaint) was a job at the fag end. My job is not to be some super policeman for all cases. Let’s not forget my role, Milords.

      Bench: The argument of the other side is acceptable or not acceptable will be decided by the Court, but SIT has to place the evidence before Court.

      Rohatgi: Yes. Second is relevant portion of Trial court judgment in Gulberg. Then Commission report. Then some judgement.

      Bench: HC judgment is reported judgment?

      Rohatgi: I’ll check. This is a confirmation judgment of a particular case.
