    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar will take up the part-heard matter for further hearing. Senior Advocate Mukul Rohatgi for SIT will continue his arguments today.

    On the last occasion, Mr Mukul Rohatgi, appearing on behalf of SIT, vehemently controverted the submissions of the Petitioner that the SIT was trying to shield someone or something. He argued that on the contrary, the details in the Closure Report demonstrate the extent to which the SIT went to in order to conduct the investigation in the matter, keeping in view and often exceeding the mandate of the Supreme Court.

    Mr. Rohatgi had also apprised the Court that the Petitioner had made serious allegations against the then Chief Minister of Gujarat with respect to delay in requisitioning of the army. However, after investigation, the SIT found out that, on the contrary, the army was called in within the first three hours of the riots. Replying to the contention, Kapil Sibal noted that he hasn't mentioned about Chief Minister, but if Rohatgi continues reading it, then he will have to deal with the same.

      Rohatgi: See the stark difference between these 9 cases and Best Bakery and Bilkis Bano. The SC did not have faith in those trials. they were transferred and after retrial there were convictions. That was not taken by SIT.

      Bench: SIT was responsible for not only fair investigation but also fair trial.

      Rohatgi: SIT was superimposed on the Government by the SC. Out of 8 every trial ended in conviction, life sentence including death sentence.

      Rohatgi: Kindly note that even the closure was taken up by a judge on a day to day basis. So, full power is given to SIT. Item 6, 7, - faith in SIT. Item 10 again SIT. Every part is on SIT. The SIT was good then and suddenly has become biased.

      Rohatgi: Then Milord, judgment I am not reading, item 7 is confirmation judgment, I have read that small quotation from that. I’ll read the recommendation of SC. [SIT did their job in 9 cases well]Therefore they (SIT) would continue to function till the end of the trial.

      Rohatgi: The finding of the HC is that the post mortem reports were proved by prosecution.

      Rohatgi: Now about post mortem. The riots in Gulberg had nothing to do with this, still SIT investigated. Kindly see the confirmation case, the argument of the defence. The argument was that there was no fire, they died because of shock, so we cannot be guilty of setting fire.
